Attorney to do jail time for trust fund embezzlement

HENDERSONVILLE, N.C. — Andrew Murray, U.S. attorney for the Western District of North Carolina, said Howard Trade Elkins embezzled from his law office’s trust account from 2012 to 2017.

Elkins was an estate attorney. He used money taken from the estates to support his own lifestyle, to gamble and for payments to other clients to satisfy demands related to his legal work, Murray said.

“Elkins’ clients trusted him and relied on him to carry out his duties as their attorney. Instead, Elkins used his law firm’s trust account as his personal piggy bank,” Murray said. “Elkins’ misconduct is reprehensible and, more importantly, it erodes the public’s trust in our legal system.”

After Elkins serves two years in prison he will be on supervised release for another two years.
