First degree murder charge in sister’s death

RUTHERFORD COUNTY, N.C. — The grand jury returned a true bill of indictment for Timothy Earl Powell for the murder of his sister last week.
The confrontation between the brother and sister on Sept. 20, 2016 resulted in the sister being shot in the abdomen.

According to Sheriff Chris Francis, Deborah Powell Hoyle, 57, of Saint John Zion Road in Rutherfordton, sustained a gunshot wound from a 358 Magnum handgun and was transported to Spartanburg Regional Medical Center. The altercation between the siblings happened about 11:30 p.m. on Friday night. Alcohol was a factor. Her brother, Timothy Earl Powell, 53, of Lemonds Road in Mooresboro was originally charged with assault with a deadly weapon with intent to kill inflicting serious injury. Hoyle has since deceased.

Powell was arrested on Sunday evening.
