RUTHERFORD COUNTY, N.C. — The hearing for motions in the State of N.C. vs. Adam Bartley case scheduled for Friday, July 18, 2017 is now pending. The presiding judge has entered a motion ex mero motu for a change of venue to Asheville and Buncombe County Courthouse via email. Judge Marvin Pope, Jr. has made a motion to schedule the trial for the first two weeks in December.
Pope doesn’t think the case could be tried in one week and given the publicity of the Covington mis-trial and contempt citation of the jury foreman feels it would be difficult to empanel an impartial jury in Rutherford County that is unaware of the trials against Word of Faith Fellowship.
Prosecutor for the State, Garland F. Byers, Jr., has responded that he is amiable to the Buncombe County change of venue, but wished to be heard if another county is proposed. Byers also noted that it was unclear if the defendant Adam Bartley had consented to an out of term, out of session, out of county, and out of district hearing.
As of this date, the Friday hearing in Asheville is still pending.
