Fenner Case: State opposes Bill of Particulars

RUTHERFORD COUNTY, N.C. — The State of N.C. is proceeding onward in the Matthew Fenner case scheduled for hearing on May 19, 2017. On Monday, May 1, 2017 prosecutor Garland F. Byers, Jr. filed the State’s opposition to a defense motion for a Bill of Particulars as requested by the Brooke Covington counsel.

A Bill of Particulars, as noted in Byers’ filing, is to inform the defendant of the charge against her with sufficient precision so as to enable such defendant to prepare her defense. Byers argues that the Indictment, documentary discovery, and information provided by the defendant to the State before she was indicted by the Grand Jury make a Bill of Particulars unnecessary.

The indictments explains in sufficient detail elements of each charge, the date of the offense and the alleged facts supporting the charges. Also included in the discovery is not only all the law enforcement investigation reports, but also previous law enforcement investigations of the Word of Faith Fellowship (WoFF) and includes interviews with the defendant herself.  A toal of 1480 pages of discovery, along with photographs, and audio recordings have been shared with the defense.

The State also denies that defendant that the Defendant requires a Bill of Particulars to prepare her defense as she already had her defense prepared before she was indicted. Covington’s lawyers at that time submitted a binder of affidavits to then District Attorney Brad Greenway detailing her account of the happenings of January 2013.

Further Byers argues that a Bill of Particulars should not be used as an investigative tool for the defense. The hearing for pre-trial motions is scheduled for May 19, 2017 at 2 p.m.

    GO GET EM’ GARLAND BYERS! WOFF IS ONLY STALLING FOR TIME. THINKING AFTER A PERIOD OF TIME, THE CASE WILL BE DISMISSED…….iT IS VERY PLAIN TO SEE THESE PEOPLE ARE TRYING TO MANIPULATE THIS COURT. AN THE PEOPLE OF RUTHERFORD COUNTY!!

    This is why Sandra Besirovic..maybe the trail needs to be moved to some city where they know NOTHING of the churches evil doings…I notice it’s sad NO ONE SPEAKS out on this page!!!I thank just all for what u are doing!
