County one step closer to taking over Airport

RALEIGH- Rutherford County Commissioners are one step closer to taking over the property, administration, and control of the airport by dissolving the status of the current Airport Authority.
HB 492 presented to the Legislature by Rep. Mike Hager on April 1st of this year was given a favorable review by the Transportation Committee and has now been referred to the State Finance Committee to be reviewed.
This bill reads “AN ACT AUTHORIZING THE RUTHERFORD COUNTY BOARD OF COMMISSIONERS TO TERMINATE AND DISSOLVE THE RUTHERFORD AIRPORT AUTHORITY AND TO OPERATE THE RUTHERFORD COUNTY AIRPORT AS A PUBLIC ENTERPRISE.”
If the Board terminates and dissolves the Authority as authorized by Section 1 of this act, the Board may order the Authority to do all of the following:
(1) To transfer to Rutherford County all real and personal property owned by the Authority. Upon the order of the Board to do so, the Authority shall execute any deeds, bills of sale, and any other necessary documents to effect the transfer of ownership to the County.
Notwithstanding the provisions of this section, the ownership of all real and personal property shall automatically be deemed transferred to the County on the effective date of the termination and dissolution of the Authority.
(2) To assign to the County within a certain time period all executory contracts to which the Authority is a party. Notwithstanding the provisions of this section, all the executory contracts and the rights and obligations thereunder shall be deemed assigned to the County on the effective date of the termination and dissolution of the Authority.
Currently the Commissioners are acting as the Airport Authority due to irregularities of the past Authority but they have to act as an independent entity concerning the airport.
This arrangement could only be dissolved by the state legislature.
The passing of this bill would put the entire operation under county control and dissolve the power of the Authority.
